  • ERISA Section 405(a) Investment performance must be monitored

  • ERISA Sections 406(a)-(b) Prohibited transactions must be avoided

ERISA states that Plan Fiduciaries are under an obligation to retain qualified investment professionals if the Fiduciaries do not have the necessary investment expertise to make investment decisions.
